Community property is a legal framework for property ownership available to married couples in specific U.S. states (including Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin). Under this structure, both spouses possess an equal and undivided right to the property acquired during the marriage. Upon the death of one spouse, the surviving spouse typically retains their half, while the deceased’s half is distributed to their lawful heirs.
